2. Using Our Website

By using our website and placing an order, you agree to these Terms & Conditions.

You must be at least 18 years old to place an order.

We reserve the right to refuse service, suspend accounts, or cancel orders at our discretion.

3. Our Products

All flowers and floral arrangements are subject to availability.

As natural products, flowers may vary in colour, size, and appearance from images shown.

Where necessary, we reserve the right to substitute flowers with a similar product of equal or greater value.

4. Prices & Payment

All prices are displayed in GBP (£) and include VAT where applicable.

Delivery charges are shown at checkout.

Payment must be made in full before an order is accepted.

We accept payment via cards / PayPal/ GooglePay/ ApplePay.

5. Orders & Contract

Placing an order constitutes an offer to purchase.

A legally binding contract is formed only when:

payment has been received, and

you receive an order confirmation email.

We reserve the right to cancel orders due to pricing errors, stock issues, or delivery limitations.

6. Delivery

We deliver to Bedford and United Kingdom.

Delivery dates and times are estimates only and not guaranteed, especially during peak periods (Valentine’s Day, Mother’s Day, etc.).

You are responsible for ensuring delivery details are accurate.

If no one is available to receive the delivery, flowers may be:

  • left in a safe place, or
  • left with a neighbour,
  • unless you specify otherwise.

Delivery is deemed complete when the order is delivered to the address provided at checkout or left in a safe place in accordance with the delivery instructions supplied by the customer. Proof of delivery may be used as evidence in the event of a dispute or chargeback.

7. Perishable Goods & Right to Cancel

Flowers and plants are perishable goods.

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day right to cancel does not apply to perishable items such as flowers.

Once an order has been prepared, dispatched, or is out for delivery, it cannot be cancelled.

8. Refunds, Replacements & Evidence

Refunds are not guaranteed and are assessed on a case-by-case basis.

A refund or replacement may be offered only where:

  • the flowers arrive damaged and unusable, or
  • the incorrect item was delivered.

You must notify us within 24 hours of delivery and provide clear photographic evidence showing the issue.

Failure to provide evidence within this timeframe may result in the refund request being declined.

Approved refunds will be processed to the original payment method only.

9. Non-Refundable Situations

Refunds will not be issued for:

  • natural variation in flowers (colour, size, bloom stage),
  • delivery delays caused by incorrect address details,
  • unsuccessful delivery where no safe place is available,
  • dissatisfaction based on personal preference rather than fault.

10. Intellectual Property

All website content, including images, text, logos, and designs, is owned by Moss&Ivy Florist Ltd. and may not be copied or reused without permission.

11. Chargebacks, Disputes & Payment Provider Claims

By placing an order, you agree to contact us directly to resolve any issue before raising a chargeback or payment dispute with your card provider, Stripe, or PayPal.

Raising a dispute without contacting us first may result in your claim being challenged using the information and evidence available to us.

For dispute resolution, we may submit the following evidence to our payment providers:

  • order confirmation and checkout acceptance of these Terms & Conditions,
  • delivery confirmation and tracking information (where applicable),
  • photographs of the prepared order prior to dispatch,
  • delivery instructions provided at checkout,
  • this Refunds & Perishable Goods Policy.

Unauthorised chargebacks may be considered a breach of these Terms & Conditions.

12. Limitation of Liability

We are not liable for:

delays caused by events outside our control (weather, courier delays, strikes),

allergic reactions to flowers or plants,

indirect or consequential losses.

Nothing in these Terms limits liability for death or personal injury caused by negligence.

13. Privacy & Cookies

Personal data is processed in accordance with our Privacy Policy and Cookie Policy, available on this website.

We comply with the UK GDPR and the Data Protection Act 2018.

14. Governing Law

These Terms & Conditions are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
